Welcome to Nikalex, Inc. (“Nikalex,” “we,” or “our”). These Terms of Use (“Terms”) govern your use of our website, online tools, and related services (collectively, the “Nikalex Online Properties”). By accessing or using our site, you agree to these Terms and our Privacy Policy.
If you are using the site on behalf of a company or organization, you represent that you have the authority to bind that organization to these Terms.

We may update these Terms from time to time. The “Last Updated” date above reflects the most recent version. Continued use of the Nikalex Online Properties after updates constitutes your acceptance of the revised Terms.
We may modify, suspend, or discontinue parts of our site at any time without notice.
2. Services and Eligibility
Nikalex provides CAD redesign (CREATE) and titanium 3D printing (MANUFACTURE) services to clients worldwide. By using our site or submitting files, you agree to the terms described here and in the Nikalex Service Agreement, which governs project-specific details, refunds, and delivery.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our services.
3. Payments
Payments are processed securely through Squarespace Payments. We accept the following:
• Visa, MasterCard, American Express, Discover, and JCB (credit or debit)
• Apple Pay
By submitting payment information, you represent that you are authorized to use the provided payment method. Nikalex does not store complete payment card data and does not handle payment processing directly.
All transactions are governed by the applicable sections of the Nikalex Service Agreement.
4. Data and Privacy
Your submission of information through the Nikalex Online Properties is governed by our Privacy Policy, available at https://www.nikalexinc.com/privacy-policy.
By using our site, you consent to the collection and use of information as outlined in that policy. You are responsible for ensuring that any information you provide is accurate and current.
5. User Accounts
If account registration becomes available, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify Nikalex immediately if you suspect unauthorized use of your account.
6. Intellectual Property
All content on the Nikalex Online Properties—including designs, text, graphics, logos, CAD samples, and software—is owned by or licensed to Nikalex. You may not reproduce, distribute, modify, or exploit any portion of the site without prior written consent.
Client-submitted CAD files and resulting project deliverables are subject to the ownership and usage terms outlined in the Nikalex Service Agreement.
7. Acceptable Use
You agree not to:
• Upload unlawful, infringing, or malicious materials
• Attempt to access or disrupt our systems or data
• Copy, scrape, or reverse-engineer site code
• Use the site for unlawful or deceptive purposes
Nikalex may suspend or terminate access if these Terms are violated.
8. Third-Party Tools and Links
Our website may include links to third-party sites or tools (such as analytics, hosting, or payment processors). Nikalex is not responsible for their content, data handling, or policies. Your use of those services is at your own risk and governed by their respective terms.
9. Warranties and Disclaimers
The Nikalex Online Properties and all related services are provided “as is” and “as available” without warranties of any kind, express or implied.
We do not guarantee uninterrupted access, error-free operation, or complete security of transmitted data. While we operate in good faith to protect client information, Nikalex is not responsible for incidents or data breaches beyond its reasonable control.
10. Limitation of Liability
To the fullest extent permitted by law:
• Nikalex’s total liability for any claim shall not exceed the total amount you paid for the service in question.
• Nikalex shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or business opportunities.
If you are dissatisfied with the site or services, your sole remedy is to stop using them.
11. Dispute Resolution
These Terms are governed by the laws of the State of California, USA.
Any dispute arising under these Terms or related to our services will be resolved by binding arbitration in Long Beach, California, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
You agree to resolve all disputes on an individual basis. Class actions and class arbitrations are not permitted.
12. Export and Compliance
You are responsible for complying with U.S. export laws and restrictions. You may not use or export our services in violation of U.S. law or to countries under U.S. sanctions.
13. Termination
Nikalex may suspend or terminate access to the site at any time without notice for conduct that violates these Terms or is harmful to our operations or users.
14. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining terms will remain in effect. No waiver of any breach constitutes a waiver of any other breach.
These Terms, together with our Privacy Policy and Service Agreement, form the entire agreement between you and Nikalex regarding your use of our website and services.
